How to Establish Paternity in Beverly Hills

Before an unwed parent can receive child support or establish visitation rights, the court must first make a legal determination of parentage. Until paternity is legally established, there is neither a legal right to receive child support, nor a legal obligation to pay child support. Additionally, the mother is under no legal obligation to allow the potential biological father to exercise visitation with the child.

Paternity may be established in one of two ways: The man may sign a Voluntary Acknowledgment of Paternity, or a Paternity Action may be filed with the Family Courts by either the man or the woman. If neither party contests the Paternity Action, the Court will issue a judicial ruling that establishes the man as the child’s biological father.

If either party contests paternity after a formal action is filed, the Court will order a DNA test. This test consists of swabbing the mouths of the mother, alleged father, and the child. DNA testing will either exclude the man as the child’s biological father or confirm his parentage.

Rights & Obligations Once Parentage is Established

Once a paternity test conclusively indicates that the man is the biological father, each party to the action will be subject to the rights and obligations as set forth in the Family Law Code.

Upon petitioning the Court, a Family Law Judge will make a determination with respect to custody and visitation if the parties are unable to settle these matters through mediation, and a child support order will be issued pursuant to California’s Child Support Guidelines.
